Public International Law, formerly called the law of nations, consists of all rules of law that applies to the subjects of international society, that is normally the states and organizations, and individuals with exceptional . Formerly, the law of peace and war now aims to become exclusively a law of peace. So all the legal norms governing international relations, that is to say, it is of prescriptive standards, prohibitive or permissive. This normative order is a factor of social organization that performs a dual function: to reduce the anarchy in international relations by ensuring coexistence between States and meet common interests (PCIJ, Lotus, 1927). It should be noted that the development of public international law is still limited by considerations of international politics. However, increasingly, the interests of policy coincide with the needs of justice. The International law must be distinguished from private international law when it is concerned. Meanwhile, all legal rules designed to regulate international relations among individuals. The study of public international law is done by the study of its formation process (I) and its characteristics (II).
